Les bâtiments militaires ne peuvent pas être l'objet de saisie, d'arrêt ou de détention par une mesure de justice quelconque ni d'aucune procédure judiciaire in rem.
Toutefois, les intéressés ont le droit de porter leurs réclamations devant les tribunaux compétents de l'Etat dont ces bâtiments battent régulièrement pavillon, sans que cet Etat puisse se prévaloir de son immunité :
1° Pour les actions du chef d'abordage ou d'autres accidents de navigation ;
2° Pour les actions du chef d'assistance, de sauvetage et d'avaries communes ;
3° Pour les actions du chef de réparations, fournitures et autres contrats relatifs au navire.
