12. Comme sous l’empire des dispositions actuelles de la loi de 1955, la prorogation de l’état d’urgence au-delà de douze jours ne peut être faite que par la loi qui devra en fixer la durée. Ainsi, si les conditions de fond de l’état d’urgence sont toujours remplies, une nouvelle prorogation par la loi sera possible. Il reviendra au Parlement d’en décider au cas par cas.
Toutefois, l’état d’urgence restant un « état de crise », ces renouvellements ne devront pas se succéder indéfiniment. Si la menace qui est à l’origine de l’état d’urgence devient permanente, c’est alors à des instruments de lutte permanents qu’il faudra recourir en leur donnant, si besoin est, un fondement constitutionnel durable.
13. Le projet du Gouvernement met en place un régime qui, sans être l’état d’urgence, le prolongeait temporairement en lui empruntant certains traits.
