Au point de vue de la forme, la validité de toute déclaration, de tout acte d'un notaire étranger ou de tout autre fonctionnaire ayant, de par les lois de son pays, les mêmes attributions qu'un notaire, doit être appréciée d'après la lex loci, savoir la loi du pays où l'acte a été passé, encore que ses effets juridiques doivent se produire dans un autre pays, où l'on voudrait s'en prévaloir.
