Le texte consiste en deux articles. Le premier insère l’état d’urgence dans la Constitution en créant un nouvel article (art. 36-1). Actuellement, l’article 36 de la loi fondamentale n’encadre que l’état de siège. L’état d’urgence pourra désormais être déclaré en Conseil des ministres sur tout ou partie du territoire, en cas de péril imminent ou de calamité publique.

Au-delà de douze jours, la prorogation de l’état d’urgence devra être validée par le Parlement. Selon l’Élysée, cette constitutionnalisation « permettra de préciser dans une nouvelle loi les mesures de police administrative qui peuvent être prises » pour faire face aux faits ayant motivé le déclenchement de l’état d’urgence.
