Le Premier ministre a présenté un projet de loi constitutionnelle de protection de la Nation.

Ce projet de loi avait été annoncé par le Président de la République lors du congrès réuni à Versailles le 16 novembre 2015, deux jours après les attentats ayant frappé la France et tué 130 personnes.

Il comprend deux articles relatifs, d'une part, à l'état d'urgence et, d'autre part, à la déchéance de nationalité de bi-nationaux nés français qui ont été condamnés pour des crimes très graves. Sur ces deux sujets particulièrement sensibles, le Président de la République et le Gouvernement ont décidé de suivre l'avis rendu par le Conseil d'Etat.

L'article 1er constitutionnalise l'état d'urgence dont le régime était jusqu'à présent seulement fixé par une loi ordinaire.

D'une part les conditions de déclenchement de l'état d'urgence ne pourront ainsi plus être aisément modifiées. C'est une garantie forte que ce régime civil de temps de crise ne pourra pas être révisé de manière inadéquate.

D'autre part, cette constitutionnalisation de l'état d'urgence va permettre aux forces de l'ordre de disposer de moyens renouvelés pour prévenir les atteintes à l'ordre public. Des mesures de polices administratives nouvelles pourront être prises, comme des retenues administratives pendant les perquisitions ou comme des contrôles d'identité sans justifier de circonstances particulières. Ces mesures ne pourront être privatives de liberté. Elles seront placées sous le plein contrôle du juge administratif.

L'article 2 du projet de loi permettra la déchéance de nationalité pour les binationaux nés Français. Cette mesure vise à sanctionner les auteurs des seuls crimes les plus graves, à l'exception de tout délit. Les règles qui leur seront applicables sont ainsi rapprochées de celles actuellement en vigueur pour les binationaux devenus Français. A la suite de la révision constitutionnelle, une loi ordinaire sera nécessaire pour fixer les modalités d'application de ces dispositions, notamment la liste des crimes pouvant conduire, en cas de condamnation, à la déchéance de nationalité.
